Intellectual Property Infringement & Counterfeit Reporting Policy
Artists upload images of their work to Juried Art Services ("JAS") for jurying, portfolios, and listings. If you own rights in a work and believe material on JAS infringes those rights, this policy is how you report it and how we act on it. Our copyright process is modeled on the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and extends to trademark and counterfeit complaints.
1. Scope
This policy applies to content posted through JAS — artwork images in applications and portfolios, storefront listings and detail pages, profiles, event pages, and messages. It covers copyright claims (handled under the notice-and-takedown process below), trademark claims, and counterfeit, forged, or falsely attributed works. JAS is a platform, not the author of user content, and does not adjudicate ownership disputes; it acts on properly submitted notices and on court orders where required.
2. How to report
Submit a report by either channel:
- Web form (preferred): /legal/report-infringement
- Email: support@jurying.net — an emailed report must include all of the required elements in Section 3.
Designated Agent for copyright notices: Copyright Agent, Juried Art Services, LLC — support@jurying.net.
3. Required elements of a report
A copyright notice must include substantially all of the following (17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work you claim has been infringed.
- Identification of the infringing material — the specific URL(s) or page(s) on JAS.
- Your contact information — full legal name, mailing address, phone, and email.
- A good-faith statement that the use is not authorized by the owner, its agent, or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.
- Your physical or electronic signature.
For trademark or counterfeit reports, provide items 2–4 plus the registered mark or registration number (if any) or a description of the authentic work/attribution, and the basis for your claim.
4. What happens after you report — timelines
| Step | Target timeline |
|---|---|
| We acknowledge receipt and assign a reference | Within 2 business days |
| If the notice is valid and complete, we remove or disable the material | Within 5 business days of a valid notice |
| We notify the affected user and forward a copy of the notice | At time of removal |
Business days exclude weekends and U.S. federal holidays. These are targets; we act in good faith and as promptly as practicable. If a report is missing required elements, we tell you what is missing and do not act until it is cured.
5. Who reviews
Reports are reviewed by our designated IP reviewer, who checks the notice for the required elements, locates the material, and makes the removal decision. Reviewers do not adjudicate the underlying ownership dispute; they act on facially valid notices and rely on the counter-notice process and the courts where the parties disagree.
6. Notice to the accused user
When we remove or disable material, we notify the affected user, tell them what was removed and why, provide a copy of the notice, and inform them of their right to submit a counter-notice.
7. Counter-notice process (copyright)
A user whose material was removed may submit a counter-notice containing (17 U.S.C. § 512(g)(3)):
- The user's physical or electronic signature.
- Identification of the removed material and where it appeared.
- A statement, under penalty of perjury, of a good-faith belief the material was removed by mistake or misidentification.
- The user's name, address, and phone, consent to federal-court jurisdiction, and acceptance of service of process.
We forward the counter-notice to the original reporter and restore the material in 10–14 business days unless the reporter notifies us that it has filed a court action seeking to restrain the activity.
8. Repeat infringers
We maintain a repeat-infringer policy. Accounts subject to repeated valid infringement notices are terminated — as a guideline, after three separate valid notices, and sooner in cases of egregious, willful, or commercial-scale infringement or counterfeiting.
9. Record retention
We retain notices, counter-notices, correspondence, and our decisions for at least three years for legal, audit, and repeat-infringer-tracking purposes.
10. Misuse
Under § 512(f), knowingly misrepresenting that material is infringing (or was removed by mistake) may create liability for damages. False reports or counter-notices also violate our Terms of Service and Acceptable Use Policy.
